The Relationship Property law affects everyone living in a relationship - whether they are married or living in a de facto relationship, regardless of whether the couple are heterosexual or same sex.

A new law introduced in 2002 resulted in a change to the law, relating to division of property when a marriage or de facto relationship breaks down. After 3 years there is a presumption of equal sharing unless the Court considers that due to extraordinary circumstances it would be repugnant to justice to do so. There is provision to avoid the provisions of the Act by entering into a "contracting out" agreement.
